End User Licence Agreement

This licence covers your use of the Hairloom application. It sits alongside the Terms of Service, which govern the service itself and the subscription, and the Privacy Policy, which governs your data. Where this licence and the Terms of Service disagree, the Terms of Service win — except in the Apple section, where Apple's terms win.

1. Licence granted

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Hairloom on devices you own or control, for your own personal use, in accordance with the usage rules of the store you got it from. You may share the report cards you create in the app wherever you like — that is what they are for.

2. Subscriptions and auto-renewal

Hairloom is free to download, and the hair analysis is a paid feature. Hairloom Pro is an auto-renewing subscription covering the scan itself and all eight readings, your twelve-week protocol, weekly re-scans with the before/after comparison, and the product checker.

• Hairloom Pro, annual — 12 months, US$39.99, renewing every year.
• Reduced annual prices of US$24.99 and US$12.99 for 12 months are offered inside the app in some situations.

You pay in your own currency at the price shown on the purchase screen before you confirm. There is no free trial. Payment is charged to your App Store or Google Play account at confirmation of purchase. The subscription renews automatically at the same period and the price shown for your plan unless you turn auto-renewal off at least 24 hours before the current period ends, and your account is charged for the renewal within the 24 hours before the period ends. You manage and cancel it in your App Store or Google Play account settings — we cannot cancel it for you, emailing us does not cancel it, and deleting the app does not cancel it. Full billing, refund and withdrawal terms are in the Terms of Service.

3. Ownership

Hairloom is licensed to you, not sold. All intellectual property in the app itself — the software, the design, the illustrations, the wording of the screens, and the prompts and scoring behind the analysis — remains ours.

Your photographs are yours. The report generated from them is yours to keep, use, save and share for your own purposes. The system that produced it is not.

4. You must be 18 or over

Hairloom is for adults. By installing and using it you confirm you are at least 18. This licence is not granted to anyone under 18, and we will close accounts we believe belong to minors.

5. What you may not do

You may not copy, modify, reverse-engineer, decompile or disassemble Hairloom; rent, lease, lend, sell or sublicense it; remove any proprietary notice; use it to build a competing product; or use Hairloom, its output or your own reports to build or train a machine-learning model.

6. Apple-specific terms

Where you obtained Hairloom from the Apple App Store, the following apply and override anything above them that conflicts:

• Acknowledgement. This agreement is between you and us only, not with Apple. We, not Apple, are solely responsible for Hairloom and its content.
• Scope of licence. The licence in section 1 is a non-transferable licence to use Hairloom on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that Hairloom may also be accessed by other accounts associated with you through Family Sharing or volume purchasing.
• Maintenance and support. We are solely responsible for providing any maintenance and support. Apple has no obligation whatsoever to provide maintenance or support for Hairloom.
• Warranty. We are solely responsible for any product warranties, express or implied by law, to the extent they are not effectively disclaimed. If Hairloom fails to conform to any applicable warranty you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by law Apple has no other warranty obligation with respect to Hairloom, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are our sole responsibility.
• Product claims. We, not Apple, are responsible for addressing any claim by you or a third party relating to Hairloom or to your possession or use of it, including product liability claims, any claim that Hairloom fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
• Intellectual property. If a third party claims that Hairloom or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
• Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party terms. You must comply with any applicable third-party terms when you use Hairloom — your mobile data plan, for example.
• Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and on your acceptance of it Apple has the right — and is deemed to have accepted the right — to enforce this agreement against you as a third-party beneficiary.

Where anything in this agreement would give Apple less protection than Apple's own standard Licensed Application End User Licence Agreement gives it, Apple's standard terms apply instead.

7. Google Play

Where you obtained Hairloom from Google Play, this agreement is between you and us only. Google is not a party to it, is not responsible for Hairloom or its content, and has no obligation to provide maintenance or support for it. Your use of Hairloom is also subject to the Google Play Terms of Service. Billing, cancellation and refunds run through Google Play as described in section 2 and in our Terms of Service.

8. No medical use, and automated output

Hairloom provides cosmetic appearance analysis, not medical advice. For hair loss concerns, see a dermatologist. It is not a medical device, it does not diagnose, treat, cure or prevent any condition, and it must not be relied on for a health decision.

The analysis is produced by an automated model. It can be wrong, it can be inconsistent between scans, and it is affected by lighting, focus and angle. It is an opinion about how something looks in a photograph — not a measurement, and not a substitute for a qualified professional. Never delay seeking professional advice because of something the app told you. The fuller statement is in the Terms of Service.

9. Warranty and liability

Except where the law says otherwise, Hairloom is provided "as is" and "as available", without warranties of any kind, and we do not warrant that it will be uninterrupted or error-free.

If you are a consumer, that disclaimer does not take your statutory rights away. You are entitled to digital content that matches the description we gave and that works as digital content of that kind normally does, and to the remedies the law gives you if it does not. We do not exclude or limit those. Our liability is otherwise limited as set out in the Terms of Service.

10. Termination

This licence ends when you delete Hairloom and your account, or if you seriously breach it. Where the law allows us a choice, we will tell you what the problem is and give you a chance to fix it before we end it. Ending this licence does not cancel your subscription — cancel that in the App Store or Google Play, or you will keep being charged. Sections 2, 3 and 9 survive the end of this licence.

This licence is governed by the laws of Poland. If you are a consumer you keep the mandatory protections of the law where you live.
